State Govt. replies to bandh call



Dimapur, March 18 (MExN): The department of Law & Justice of the Government of Nagaland today issued an official circular reminding that the Supreme Court has ruled ‘bandhs’ illegal  as they infringe the fundamental freedom of other citizens.
The circular was issued by Secretary to Government of Nagaland KN Chishi today. “The issue of calling ‘bandh’ by various organizations and political parties was examined by the honorable Supreme Court in the Communist Party of India (M) versus Bharat Kumar and others (case),” the government  stated.  The Supreme Court issued a judgment on November 12, 1997 that ‘bandh’ interferes with the fundamental freedom of other citizens.
“There cannot be any right to call or enforce a bandh, which interferes with the exercise of fundamental freedom of other citizens,” the Supreme Court had stated. The said judgment of the Supreme Court was reiterated by the court in its order on September 30, 2007 in the case relating  to  AIADMK  versus  the  Chief Secretary, Government of Tamil Nadu and others. The Nagaland Government’s  reminder comes in the wake of the opposition Congress party in Nagaland calling a statewide bandh for March 20 against alleged corruption, tainted ministers and  scams  under  the NPF-led  DAN  government.
