Cop sentenced to 6 years for sexual assault on minor in Nagaland

Phek, July 14 (MExN): A police personnel serving under DEF as Town Head Constable in Phek was sentenced to 6 years of imprisonment and a fine of Rs 6000 under section 10 of the Protection of Children from Sexual Offences (POCSO) Act for sexual assault on a minor.


Special Judge, POCSO Act, and District and Session Judge, Phek, Mezivolu T Therieh, sentenced the accused, Zaphet Kuki, after he was found guilty of sexually harassing the minor on January 18, 2020, according to a press release from Public Prosecutor Samuel Ritse. The judgment was passed on July 14 as per the court order.


The accused was  convicted and sentenced  for a term of 6 (six) years imprisonment and fine of Rs 5000 under section 10 of the POCSO Act and in default of payment of fine he shall further undergo one year imprisonment.  The accused was further sentenced to one year imprisonment and fine of Rs 1000 under section 509 of the Indian Penal Code and one month imprisonment under section 29 of the Police Act.  In case of default of payment of fine of Rs 1000, the accused shall undergo 2 months imprisonment.  All the jail sentences are directed to run concurrently. 


The Court also directed that on the recovery of total Rs 6000 as fine from the accused, the victim shall be paid Rs 5000 as compensation. The accused was sent back to jail for undergoing the sentences of imprisonment.
