The Gauhati High Court Kohima Bench, on November 28, has once again directed for the personal appearance of the contractor of the ongoing National Highway (NH)-2 road construction project from Kohima-Mao Gate, before the Court.
Resuming the hearing of a suo moto Public Interest Litigation (PIL) concerning the project on Monday, the counsel for the Contractor (M/S Fortune Groups) assured the Court that the work will be “taken up on war footing.”
However, in view of the previous order passed by the Court on November 17, the Division Bench of Justice Songkhupchung Serto and Justice Devashis Baruah directed the contractor to “appear in person” on the next hearing, which was fixed on December 2.
It must be noted here that on November 17, the Court imposed a penalty of “at least Rs. 10 lakhs” on the contractor citing slow progress of work, willful disobedience of directives and negligence, commitment failures, among others.
It further observed that the Contractor has committed contempt of the Court prima facie and issued notice to the latter offering a ‘chance of being heard’ and explain “as to why any order to that effect should not be passed and appropriate punishment under the law should also not be imposed.”
