Rio wants dynamic, effective legal system

KOHIMA, MAY 24 (MExN): Nagaland Chief Minister Neiphiu Rio also cautioned that to effect separation of judiciary from executive the existence of a vibrant Bar is an essential feature. “Without the existence of a proper Bar in the rest of the 8 districts in the state, separation will be incomplete”, said Rio, while addressing the inaugural session of the Consultative meet. Therefore, Rio asserted that in the context of the Nagaland state, the separation of judiciary from executive will have to be examined in the light of having a legal system that is dynamic and affective, to administer justice to a wholly tribal population with divergent needs.

It may be mentioned here that the state government had earlier in 1994 decided separate judiciary from the executive subject to safeguarding the function of customary courts in the administration of justice. Consequent upon, sub-committee were form to worked out the possibilities. The rules for administration of justice and police 1937 was technical criminal code, therefore although the Indian penal code has always been in force, the complexities of the code would be difficult to comprehend and the people would not be able to defend themselves, it said.
