The 6th session of the 14th Nagaland Legislative Assembly (NLA) today passed two government bills.
The Government Bill on “The Rules for Administration of Justice and Police in Nagaland (Fifth Amendment) Bill, 2025” was passed on March 7.
This Bill was introduced on the floor of the House by Chief Minister Dr. Neiphiu Rio on March 6.
Dr. Rio stated in the statement of objects and reason that Chapter IVA of the Rules for the Administration of Justice and Police in Nagaland, 1984 was inserted by the Third Amendment of the Rules and received the assent of the President of India on 14th March, 1982.
Chapter IVA provides for constitution of the Customary Courts in Nagaland with different levels of administration for the purpose of adjudicating disputes, both civil and criminal cases in accordance with the Naga customary laws and practice.
However, it has not been notified till date and therefore, the provision could not be implemented.
And in order to implement chapter IVA of the Rules, certain rules are required to be amended to meet the changing times. Therefore, a Committee was set up vide Order dated 22nd February 2024 to examined the entire provisions of the Rules and accordingly, certain amendment of the provisions has been recommended.
The recommendation of the Committee was forwarded to the Department of Law and Justice for vetting, wherein the department made further modifications.
And while doing so, there are certain substantive amendments of the provision from the principle rules have been proposed, and since substantive amendment can be made only by the State legislature, the amendment Bill is necessitated in order to safeguard the separation of powers and to give supremacy to the amendment made there under, according to Chief Minister Dr Neiphiu Rio and minister in-charge of law and justice department.
Another bill on “The Nagaland Work-Charged and Casual Employees Regulation (Second Amendment) Bill, 2025” have also been passed today.
In statement of object and reasons, Dr Rio, who is minister incharge of P &AR stated that the object of this bill is to amend the Nagaland Work Charged and Casual Employees Regulation Act, 2001 by amending Chapter 11 (3) (2) & (D) after section 3 (1) of Chapter 11 of the principal act regarding the constitution of the Work Charged & Casual Employees Commission.
