An Assistant Professor in English Department posted at Wangkhao Government College, Mon has approached the Gauhati High Court, seeking among others, the reason why he was transferred twice in just over a month.
According to the order issued by the Court on December 2 after hearing a writ petition on the issue, the teacher was first transferred to Dimapur Government College by general transfer order issued by the Department of Higher & Technical Education on October 10, 2022.
However, another order issued by the same Department a month after on November 11 informed that the teacher was transferred to Sao Chang College Tuensang “without giving any reason or justification
Aggrieved by the second order, the teacher approached the Kohima HC Bench seeking redressal.
On Friday, the counsel for the petitioner submitted that when a transfer order has been issued, if the same authority issues another order modifying or changing the same, reason should be given otherwise the order becomes illegal.
Accordingly, the single-judge HC Bench Justice Songkhupchung Serto issued notices to respondents, including the Secretary and Director of HTE Nagaland, returnable within 4 weeks.
Listing the matter again for hearing immediately after 4 weeks, the Court also said that the November 11 order will remain in abeyance in respect of the petitioner and the private respondent.
