‘Change of Name’ in Service Book: HC Kohima asks for detailed ‘norms and rules’ of Nagaland Govt

Kohima, May 6 (MExN): The Gauhati High Court Kohima Bench on May 6 directed the Additional Advocate General (AAG) of Nagaland to file a detailed affidavit indicating the 'norms and rules' of the Government regarding the 'change of name' of employee in the Service Book. More specifically, the Court requested the rules that were in effect during the year '2002' in relation to a writ petition regarding a name change that it is currently hearing.

According to the Court records, the current case involves an employee of the Government of Nagaland who served under the Department of Police, 5th NAP Battalion for 35 years and retired on October 30, 2017. However, despite receiving the GPF and other pensionary benefits upon retirement, his monthly pension has not been paid despite repeated representations to the respondent authorities. Consequently, he filed a writ petition in 2023.

Meanwhile, according to an order issued by Justice Kakheto Sema on May 7, during the course of the hearing, the Government Advocate submitted that the petitioner had changed his name in the Service Book, violating the 'rules and norms' of the Government. However, the Government's affidavit does not provide any discernible information regarding the applicable norms or rules for changing the name of a Government employee in the Service Book.

In this regard, Justice Sema asked the AAG to file the detailed affidavit within two weeks and scheduled the matter for further hearing after the said period.
