Tseminyu, June 24 (MExN): Deputy Commissioner of Tseminyu, Japheth Woch, has informed the public that Legal Heir Certificates can be obtained from the office of the Deputy Commissioner for purposes such as processing family pension, gratuity, salary arrears, General Provident Fund (GPF), insurance claims, ex-gratia assistance and other related benefits.
In a notification, the DC encouraged residents of Tseminyu district to apply for the certificate by obtaining the prescribed form from the DC's office.
A fee of Rs 20 will be charged for the application form and Rs 50 for issuance of the certificate, the notification stated.
Eligible applicants include the spouse of the deceased, children of the deceased, grandchildren of the deceased and siblings of the deceased.
The notification clarified that a second wife would be recognised as a legal heir only if the marriage was legally valid, following dissolution of the first marriage through divorce or in the event of the death of the first wife.
It further stated that illegitimate children are entitled to all property rights of the deceased parent and are considered legal heirs of the deceased.
The DC also referred to a 2005 Supreme Court ruling, stating that daughters, whether married or unmarried, enjoy the same inheritance rights as sons.
Applicants have been asked to submit a signed application form, identity and address proof of the applicant, death certificate of the deceased, date-of-birth proof of all legal heirs, a self-undertaking affidavit and address proof of the deceased.
Acceptable proof of identity includes Aadhaar card, voter identity card, driving licence, passport, PPO book or any other government-issued identity card.
Address proof may include a valid identity document, mobile bill, gas connection bill, bank passbook bearing the applicant's name and address, or Aadhaar card.
Date-of-birth proof may be furnished through a birth certificate, school transfer/leaving certificate, PAN card or other valid documents, the notification added.
