High Court disposes off 3 petitions 'upholding' equal pay for equal work

Upholding its earlier stance of ‘equal pay for equal work’, the Gauhati High Court, Kohima Bench on June 9 disposed off 3 writ petitions giving directions to State respondents to consider the petitioners’ representation to pay monthly with “scale of pay payable to the employees of the same grade.”

The first was the case of a ‘contingency Animal Attendant’ under the Dairy Up-grading Centre, Peren, Nagaland appointed on April 4, 2012.  After serving for 10 years, she submitted a representation on April 19, 2022 to the Director, Veterinary and Animal Husbandry, Kohima requesting payment of her monthly salary with Scale of Pay payable to employees of the same grade. 

The second cased pertained to a contingency Driver serving under the establishment of District Youth Resources Officer, Peren. He was appointed to service on December 12, 2011 and after serving for 10 years and 5 months, he submitted a representation to the Director, Directorate of Youth Resources and Sports, Kohima with similar request as the first petitioner. 

The third was the case of a contingency Casual Labour under the Superintendent of Food & Civil Supplies, Peren, appointed on June 20, 2015. After serving for 16 years, he also submitted a representation on April 25, 2022 to the Director, Directorate of Food and Civil Supplies, Dimapur with similar prayer as the previous two petitioners. 

As the representations remained unanswered, the petitioners approached the Court separately praying for issuance of appropriate writ or order directing the state respondents or concerned authorities to pay their monthly salary with scale of pay payable to the employees of the same grade.

Accordingly, Justice Songkhupchung Serto disposed off the three petitions separately with a direction to the State respondents to “consider and dispose the same within a period of three months from the date of receipt of a copy” of the Court’s order. 

In case the petitioners are not satisfied with the results, they can approach the Court again, the orders added.
