The Gauhati High Court Kohima Bench has temporarily suspended the investigation into a case against Dimapur-based businessman Nirmal Kumar Jain over allegations of furnishing false information to obtain a Non-Naga Indigenous Inhabitant Certificate issued in 2002.

In an order dated November 2, Justice Helen Daungliani directed that the investigation in Dimapur Sub-Urban Police Station remain suspended until the next date of hearing on November 26.

As per the Court’s order Jain has approached the High Court seeking quashing of the First Information Report (FIR) registered against him under Sections 319(2), 318(2) and 212 of the Bharatiya Nyaya Sanhita (BNS), 2023, dealing with cheating by personation, cheating and harbouring or concealing an offender, respectively. The petition was filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.

The FIR (First Information Report) was lodged by the Dimapur Naga Students’ Union (DNSU), alleging that Jain furnished false information to procure the certificate, issued on March 14, 2002, it added.

The case follows allegations raised by DNSU concerning the certificate and land transactions allegedly facilitated through its use. The union has called for an investigation and action over the alleged fraudulent land dealings.

As an interim measure, the High Court directed the State to produce a scanned copy of the case diary through the Public Prosecutor. It also directed businessman to file an additional affidavit incorporating the FIR within the week, with a copy to be served on the Public Prosecutor.

The Court has not yet decided the petition seeking quashing of the FIR. The matter is listed for further hearing on November 26.

In public domain, while DNSU has publicly voiced concerns over the slow progress of the investigation, Jain has denied any involvement in the alleged wrongdoing.
