A government bill on “The Nagaland Goods & Services Tax (Amendment) Bill, 2020” has been passed at the 6th session of 13th Nagaland Legislative Assembly (NLA) here today.
The Bill was passed on the floor of the House after it was moved by Chief Minister Neiphiu Rio for consideration and passing.
In the statement of objects and reasons, Rio stated that the Goods and Service Tax (GST) has been implemented with effect from Ist July, 2017.
Implementation of GST is regulated by the Central Goods and Service Tax (CGST) Act and the State Goods and Services Tax (SGST) Act.
The central government has inserted a new Section 168A in the CGST Act, 2017 with effect from 31st March 2020 through Chapter VII of Ordinance No.2 of 2020.
The state governments have been requested to effect corresponding amendment in the SGST Act with effect from 31st March 2020 so that uniformity of decision and all applicability is maintained.
It stated that as the Legislative Assembly was not in session, in the exercise of powers conferred under Clause (1) of Article 213 of the Constitution of India, the Governor of Nagaland promulgated the Nagaland Goods and Services Tax (Amendment) Ordinance, 2020 on 10th June 2020 which was notified in the Nagaland Gazette Extraordinary.
Rio stated that the Nagaland Goods and Services Tax (Amendment) Bill, 2020 would enable the state government to extend the time limit specified under the Act in respect of actions which cannot be completed or complied with due to force majeure.
On financial statement, it stated that the introduction of the Nagaland Goods & Services Tax (Amendment) Bill, 2020 will not entail expenditure on the Consolidated Fund of the State as it can be implemented by the existing administrative set up.
