Next hearing of ‘consensus candidate’ issue on Dec 13

HC Kohima Bench currently hearing petitions relating to ‘village declaration’ of candidate in Chungtia and Mongsenyimti Village

The Gauhati High Court Kohima Bench has listed the next hearing of the matter relating to writ petition against the declaration of a “consensus candidate” and ‘consequential notice’ issued by Chungtia Village Council (CVC) on December 13. 

While the matter was scheduled for hearing on December 9, it was deferred at the request of the counsel for the petitioner, informed an order issued by the Court on Friday. 

The matter was first heard by the Court on October 27, after a petition was filed against resolution adopted by the Chungtia Senso Meeting (Chungtia Citizens’ Meeting) on December 28, 2021 designating a “consensus candidate of the village for the 28 Koridang A/C” and a notification issued by the Chungtia Village Council (CVC) thereafter “informing and warning all the villagers” of penalty of 7 pigs if they go against aforesaid resolution.

The Court then issued notice making the same returnable within five weeks, but stated that an interim prayer for the stay of the December 28 resolution and the subsequent ‘consequential notice” would be heard on the next returnable date.

Meanwhile, on December 5, the Kohima Bench in an interim suspended until further orders an “Decision/Resolution dated 28.12.2021” made by the Mongsenyimti Riongsanger Putu Menden/Village Council as well as an announcement “dated 01.06.2022 made by the Mongsenyimti Riongsanger Putu Menden/Village Council” and another dated 19.10.2022 made by the Mongsenyimti Riongsanger Putu Menden/Village Council.

It further suspended until further orders the “Information/Announcement dated 23.10.2022 made by the Mongsenyimti Senso Mungdang” and listed the matter for hearing after four weeks.

It must be noted here that the apex citizen organisation of Mongsenyimti (Mongsenyimti Senso Mungdang) in an announcement dated October 23, informed that a citizen of the village has ‘voluntarily’ given up citizenship rights and has been ‘excommunicated.’

However, in a clarification later, the concerned individual informed that the issue was election-related and he ‘gave up' his citizenship over his inability to accept a resolution adopted during a Citizens’ meeting last December (28) declaring a particular person as the village’s candidate in the upcoming Assembly election. 

 The declaration was followed by a notice by the village council restricting any other villagers from contesting, apart from the declared candidate.
