Sentences remitted against certain categories of prisoners

Kohima, August 27 (DIPR): Whereas in commemoration of the ensuing anniversary of Independence Day 2010, the state Government has decided to remit the sentences against certain categories of prisoners who have been convicted by the courts (other than Court Martial) having criminal jurisdiction in the state of Nagaland and sentenced to rigorous imprisonment. 

Now, therefore, in exercise of the power conferred by Sub section 1 of Section 432 of the Code Criminal Procedure, 1973 (Act No. 2 of 1974 herein after referred as the said Code) the Governor of Nagaland is pleased to grant remission of sentences to the different categories of prisoners as specified below, lodged in the jails of Nagaland and outside other than those in respect of whom the sentence is inflicted for an offence against the Order referred to in Sub-section 6 of Section 432 of the said Code passed under any law relating to which the Executive Powers of the Union extended. 

The scale of remission of sentence for different categories is specified as given: Prisoners sentenced to 10 years and above-30 (Thirty) day’s; prisoners sentenced to 5 years to 10 years-20 (Twenty) days; Prisoners sentenced to 1 year to 5 years - 10 (Ten) days and Prisoners sentenced up to 1 year - 5 (Five) days. 

Further, the aforesaid remission granted under the order shall not be admissible to the following categories of prisoners: Prisoners convicted under Foreigners Act; Prisoners convicted under Passport Act; Prisoners convicted under Unlawful Activities (Prevention) Act; Prisoners convicted under Section 3 to 10 of Official Secrets Act, 1923; Prisoners convicted under Section 2 to 3 of Criminal Amendment Act, 1961; Prisoners convicted under Section 121 to 130 of IPC; Prisoners convicted under Section 107/109 of Cr PC; Prisoners convicted under Prevention of Corruption Act; Prisoners convicted of rape, attempt to rape or assault on women; Convicted prisoners found violating jail rules and discipline such as threatening/ intimidation/quarrelling/beating of fellow prisoners/staff and smuggling of contraband and prohibited articles and Foreign National convicted under any Acts. 

However, the following convicts will not be eligible for grant of remission as per Govt. Rules/Order: Yimsa-District Jail, Tuensang; Mahabir Singh-District Jail, Mokokchung; Salim Mullah District Jail, Kohima; Limatiba-District Jail, Mokokchung; Kumlijungba-District Jail, Mokokchung; Imtitingzuk-District Jail, Mokokchung; Imtimoa-District Jail, Mokokchung; Sentilepzuk-District Jail, Mokokchung; Imtitoshi-District Jail, Mokokchung; Lipokrenba Stm-District Jail, Mokokchung; Lungmaheu-Sub-Jail, Peren;  Dilen Zeliang-Sub-Jail, Peren; Selipi Sangtam-Sub-Jail, Kiphire; Mughalu Sumi-Sub-Jail, Zunheboto; Tovishi Sumi-Sub-Jail, Zunheboto; Vinoka Sutni-Sub-Jail, Zunheboto; Bonato Sumi-Sub-Jail, Zunheboto.

The Remission Order will take effect from August 15, 2010 by the Order in the name of the Governor. This order was issued by the Home Department: Home Branch Government of Nagaland.
