
PHEK, AUGUST 29 (MExN): One person has been sentenced to 15 years rigorous imprisonment for possession and control of 200 kgs of contraband ganja and fined Rs 2 lakhs by the Court of the Special Judge, NDPS Act, Phek, Mezivolu T Therieh. In case of default of the fine payment, the accused will further undergo 2 years rigorous imprisonment.
A press release from the Special Public Prosecutor, Phek, Samuel Ritse informed that the accused, Wilson Domeh, was sentenced by the Court on August 29.
The release informed that on October 29, 2020, at about 7:30pm, contraband ganja in 20 packets weighing 200 kgs was loaded in a Maruti Alto 800 at Zapami village area. Wilson and a co-accused (who is acquitted) on seeing the police turned the car and drove to Lekromi village and abandoned the vehicle, it said.
Through the RTO app, the owner of the vehicle was traced and the accused persons were subsequently arrested and trial conducted.
In the judgment, the Special Judge, NDPS held "…It can therefore safely be inferred beyond all reasonable doubt that Wilson was in exclusive possession of 200 kilograms of ganja and it was under his complete custody and control. For these reasons, I hold Wilson guilty of being in possession and control of 200 kilograms of ganja which is a commercial quantity and convict him under section 20(b) of the Act…"
While pronouncing the sentence, the Special Judge held that "....It is true that Wilson has a family to look after but the fact remains that he has been found in possession and control of huge commercial quantity of 200 kilograms of ganja which is banned. As rightly pointed by the prosecution, Wilson was earlier convicted in a similar case in Criminal Case vide Pfutsero PS Case no.009/12. Wilson being a habitual offender, his criminal behaviour definitely cannot be taken casually.”
The case was investigated by UBSI Seyielhouca Kehie, PS, Pfutsero and Samuel Ritse, Special Public Prosecutor, POCSO Act, Phek led the prosecution.
