
Dimapur Bar Association writes to CS over lapses in administration of justice
DIMAPUR, JUNE 10 (MExN): The Dimapur Bar Association (DBA) has written to the Chief Secretary of Nagaland with regard to the complaint made by the concerned counsels of the accused Deepak Borah, which was also published in this newspaper. “It appears that the Assistant Jailor namely Mr. David of the Central Jail under the Dimapur District has indirectly or directly involved in connivance with known persons to the said Asst. Jailor in the abduction of the accused Deepak Borah, from within the Central jail premises while the counsels of the accused Deepak Borah were waiting for the release of the said accused from the said Central Jail Dimapur”, stated the representation issued by DBA President Imti Imsong and Secretary K.L John.
In this connection the DBA also mentioned to the Chief Secretary that it had learnt from the counsels that “they were illegally confined, threatened with dire consequences and their client was beaten in their presence within the Jail premises and before the very eyes of the jail staffs and security personnel”.
According to the DBA, it also “appears that the Diphupar police Station Dimapur has also failed to take any step, inspite of lodging FIR by the concerned counsels made with regard to the abduction of the accused Deepak Borah by persons known to Assistant Jailor Mr. David from within the jail premises and to locate the whereabouts of the abducted person, Deepak Borah”.
“It is pertinent to mention herein that one of the abductor had directed the Diphupar Police personnel not to initiate any steps which indicate serious implication and lapses on the working system of Diphupar Police station”, observed the DBA.
In this regard, the DBA stated that the legal fraternity had viewed with all seriousness that the acts of the Assistant Jailor and known persons to him are a direct attack on the legal profession and administration of Justice. “The jail authorities and police are the custodians of law however, when the said authorities indulge in such illegal activities, it will ultimately result in the total breakdown in the administration of Justice, thereby endangering the security of the citizens and innocent public”.
Therefore, the DBA requested the Chief Secretary to take “immediate suitable action within a period of 15 days from the date of submission/ publication against the erring Assistant Jailor as deem fit and proper and to take immediate step to rescue the abducted person from the hands of the known persons to the Asst Jailor”.
Further, the DBA requested the Chief Secretary to make enquiry against the concerned police personnel of Diphupar P.S. as to why such a cognizable offence was not immediately registered. Failure to comply with the above representation, the DBA stated that it will be constrained to take suitable steps as deem fit and proper.
