Nagaland Pharmacies told to get in line

Kohima, August 7 (MExN): The Nagaland State Pharmacy Council has issued a public notice reminding citizens and stakeholders about the legal provisions under the Pharmacy Act, 1948, cautioning that violations will attract significant penalties including fines and imprisonment.

Citing Sections 26A(3), 41, and 42 of the Act, the Council informed the legal consequences for obstructing Pharmacy Inspectors, impersonating registered pharmacists, and unauthorized dispensing of medicines.

Section 26A(3) of the Act states that “Any person wilfully obstructing Pharmacy Inspector in the exercise of the powers conferred on him by or under this Act or any rules made thereunder shall be punishable ‘liable to penalty which may extend to one lakh rupees’.”

The Council further highlighted that under Section 41, individuals falsely claiming to be registered pharmacists are liable for severe penalties. The section reads: “If any person whose name is not entered in the register of the State falsely pretends that it is so entered or uses in connection with his name or title any words or letters reasonably calculated to suggest that his name is so entered, he shall be punishable on first conviction with fine which may extend to one lakh rupees and on subsequent conviction with imprisonment which may extend to three months or with fine not exceeding two lakh rupees, or with both.”

Moreover, Section 42 of the Act deals with the illegal practice of dispensing by unregistered persons. The provision states: “Imprisonment for a term which may extend to three months, or with fine which may extend to two lakh rupees, or with both.”

The council urged all concerned to adhere strictly to the provisions of the Act and warned that violators would face action as per the law.
