The undersigned have the honour to bring forward the following few lines for favour of your kind perusal and intervention please.
That Sir, as appended in Chapter II Rules 3 Clause (i) of “The Nagaland Communitisation of Electricity (Management in Urban Areas by Urban Electricity Management Board) Rules 2004 the electric consumers of Kumlong Ward Mokokchung had a general meeting on 10th March 2012 after taking the consent of the majority of the public (through signature campaign) and formed the General Council and elected an Executive Committee consisting of seven members.
Again, the General Council had its second General Meeting on 5th April 2012 and resolved to dissolve the existing UEMB as it was not formed according to the above Rules and set up a new UEMB (the resolution of both the meetings were endorsed to the Executive Engineer Electrical Mokokchung).
At this point of time, there arose a billing dispute between the Department of Power and the then UEMBs as a result of which all the UEMBs in Mokokchung were suspended by the All Ward Union, Mokokchung in the month of March 2012. Then on 30th March 2012 the then UEMBs of the town paid the pending bills to the department (since Aug/Sept 11). The Executive Committee Chairman of the Kumlong Ward Mokokchung on 26th March 2012 in the meeting at the Deputy Commissioner’s conference hall in presence of the SDO(C) and EAC Mokokchung said that on payment of the due bills the E.E. refunded an amount of Rs.4,45,000/- (Rupees Four Lakh Forty Five Thousand)only to the ward.
The General Council in its second General Meeting on 5th April 2012 constituted an audit committee of three members as appended in Chapter II Rules 10 Clause 2 Sub Clause (v) and called for audit of the then UEMB on three occasions (letter dated 30/4/12, 14/5/12 and 27/6/12) but on all these occasions they refused to come citing different reasons despite the directive given by the District Administration on 26th June 2012 meeting to audit the financial position of the then UEMB. We also regret to mention that non of the goanboras of the ward attended the two General Meetings despite wide publicity by the General Council through media and public announcement. It is also worth mentioning that in our ward the secretary of the then UEMB was a Goanbora and there were also other Goanbora member in the UEMB.
Then on 30th June 2012 the Executive Engineer (E), Mokokchung Electrical Division and the All Ward Union Mokokchung had a meeting in the Office of the Executive Engineer (E) Mokokchung and among the seven points resolved, the fifth (5th) point was “as per Clause 18 of Model Rules 2004, Removal of Difficulties, it shall be requested to the Chief Engineer (Power) Kohima, that the “Ward Executive” is “General Council” as defined in the Model Rules 2004” and so the General Council had written to the E.E. on 2nd July 2012 that the above point shall not be applicable to Kumlong Ward Mokokchung as we already have a constitutionally formed General Council and UEMB. It is also worth mentioning how the Executive Engineer (Electrical), Mokokchung Electrical Division had the above meeting with the All Ward Union Mokokchung when the Union is not a recognized body by the Government and also how the Ward Executive can be the General Council (as per the 5th point of their 30th June 2012 meeting) when the Ward Executive is also not a Government recognized body.
