A plea to ensure Rights and Privilege of Disabled aspirants

(The Memorandum submitted to the Chairman, NPSC dated25/01/06 on be-half of the disabled aspirants is re-produced herewith, wherein I was assured of an addendum “in a week time”. Though the addendum never appeared, I was hopping at least the NPSC has been informed of tens of disabled aspirants, henceforth. My high hopes were jolted in the Prelims when they failed to provide space for us to mention the category of our disability in the OMR sheet, unlike the “Backward Tribes”. Hence, as a last resort to redress our grievances a Representation dated 05/05 has been submitted to the Chief Secretary for his kind intervention)

Sir, It pains me to note that even after commemoration of 10th birth anniversary of Disability Act, 1995 just a month back, your esteem Commission’s Advertisement vide NPCS/ADVT No. 5/2005-06 filed to specify whether or not any post is reserved for disabled person. If no such reservation has been made say on the ground of nature of work required, then it should have clearly stated that “Disabled need not apply”. This I think is in an apparent contravention and contrary to the notification and directives of Central/State Govt’s. 

Sir, it’s been 36th year, since the Prime Minister’s directives (No. 976 P.M.O. -80 dated 14/06/1980) to the Chief Minister, Nagaland, “to identify post for disabled persons under the State Govt Undertakings”. Given the State Govt’s disinterest in the implementation of this/that Central Directives, some years back the Centre has intimated the identification of various posts for disabled person “to the Disabilities Commissioner, Nagaland”. How is it then, the refraining of disabled from NPSC examinations is being continued on the pretext of non-identification of post?

Sir, it was only to accelerate the integration of disabled to the mainstream, the State Govt.  in its Administrative Reforms, (2004) has notified thus; “Henceforth all Advertisements to direct recruitment in the Govt. of Nagaland and its Pubic Undertakings shall carry a notice that 5% of the vacancies are reserved for persons with disabilities with immediate effect.” The fact remains that, whether notified or not, the NPSC cannot go on sidelining the unemployment problems of the excluded section, which include the disabled. As part of human diversity, no society can treat a path of progress leaving behind a part of their population.

Moreover, the NPSC being an independent Commission of the State and by virtue of the Persons with Disabilities (Equal Opportunity, Protection of Rights and Full Participation) Act., 1995 in its knowledge is duty bound to honor it . 

Sir, I therefore in the interest of the aggrieved community and public in general seeks from your high authority to ensure the rights and privileges of the disabled as guaranteed by numerous Acts and Legislations and further for a clarification or addendum through the local print media against the Commission’s Advertisement NPSC/ADVT No. 5/2005/06 on the question of whether a disabled can apply or not. If in affirmative, then the pattern of reservation and suitability of the post for each type of disability should be specified. Failure to do so will send a wrong signal, where parents and guardians would realize the vanity of spending their time, money and energy on the education of their disabled children. 

It is prayed that this memo be treated with due urgency.
