Nagaland: Man gets 10 years rigorous imprisonment for raping minor

Kohima, June 23 (MExN): A special POCSO court in Kohima, on June 16, convicted and sentenced a man to 10 years of rigorous imprisonment (RI) along with a fine of Rs 5000, for rape of a minor girl.


The Special Judge, the Protection of Children from Sexual Offences (POCSO) Act, Kohima, Neichochiyi Suyie also ordered for payment of Rs 1,25,000 to the victim as compensation under the Nagaland Victim Compensation Scheme, 2012.


According to a press release from the Special Public Prosecutor, Kohima, Kathu Rengma, the accused, Robert Debbarma had raped the victim, aged about 13 years old, in July 2018.


The accused person was arrested on January 28, 2019 following an FIR filed by a member of Child Welfare Committee, Kohima. The instant case was investigated by UBSI Levinuo Nguwi who submitted charge sheet against the accused person, it said.


During trial altogether eight prosecution witnesses were examined to prove the case. “After hearing the Learned Special Public Prosecutor and the Learned Defense Counsel and considering the evidence on record,” the Special Judge ruled that accused Robert Debbarma who was living with the victim in the same house had committed rape upon the minor. Accordingly, the accused Debbarma was convicted on March 11, 2020 under section 376(2) (f)(i)(j) of the Indian Penal Code and under section 6 of the POCSO Act, it said.


However, due to COVID-19, hearing on the quantum of punishment was taken up only on June 11, 2020 and accordingly on June 16, the Special Judge gave the final order and sentenced the accused person to10 years Rigorous Imprisonment and to pay a fine of Rs 5,000 for the offence committed under the said sections of Law as aforementioned, the release stated.
